A new flat with no surprises at handover

Three situations where what counted was what the documents showed, not the developer’s brochure.

01 Buying from a developer with no commission from the buyer The most common question: “how much will the agent add to the price?”. See how we handled it

The clients were comparing several developments and assumed an agent’s work would push up the cost of buying. On the primary market it does not — the fee comes from the developer.

  1. We set out the developments meeting the criteria: district, floor area, completion date, budget.
  2. For each we gave the developer’s price and the payment schedule — with no commission of ours added for the buyer.
  3. We checked the developer: completed projects, whether earlier phases were delivered on time, the rachunek powierniczy (escrow account) and cover by the Deweloperski Fundusz Gwarancyjny (Developer Guarantee Fund).

The clients paid the developer’s price. Our commission from the buyer on the primary market is 0%.

02 The developer contract — clauses that are easy to miss The contract runs to dozens of pages and is signed at a notary. See how we handled it

The clients had chosen a flat and received the draft developer contract. Without reading it point by point it is hard to catch the clauses on permitted changes to the floor area, penalties for delay and the scope of the finishing works.

  1. We went through the contract and listed the points to clarify: the floor-area tolerance and how any difference is settled, deadlines and contractual penalties, the finishing standard, the handover and defect-rectification procedure.
  2. We checked the payment schedule against the construction stages and the rules of the escrow account.
  3. We were there at the signing before the notary and translated the clauses into plain language for the client.

The clients signed knowing what was in the contract — and what else could still be raised with the developer before signing.

03 Technical handover with a list of defects to fix The stage where it is easiest to lose money — and easiest not to. See how we handled it

The flat was ready for handover. The developer set a date and the clients did not know what to look at, or what they were entitled to enter in the protocol.

  1. We arranged the handover and went through the flat point by point: risers and installations, windows, ventilation, humidity, how true the walls and screed are, and whether the floor area matches the contract.
  2. The defects went into the protocol with photographs and a deadline for rectification — the protocol is what makes the fixes enforceable.
  3. We checked the settlement of any floor-area difference where the measured area differed from the contracted one.

The defects were put right within the deadline set in the protocol, and the clients took the keys to a flat that matched the contract.
