Building plot: MPZP and warunki zabudowy (WZ) explained
Building plot in Warszawa and around: how to check MPZP and warunki zabudowy, the cost of an extract and a WZ, and the planning reform of 1 September 2026.
Whether you can build on a plot is decided by two documents: the miejscowy plan zagospodarowania przestrzennego (MPZP, the local zoning plan) or — when there is no plan — the decision on warunki zabudowy (WZ, planning conditions). You can check the MPZP free of charge in the municipal geoportal, while the official extract and map excerpt cost a maximum of PLN 250 and usually take 7 to 14 days. A WZ application means a stamp duty of PLN 598 (the owner is exempt), and the statutory deadline for a decision on a single-family house is 90 days. As of 15 August 2026: on 31 August 2026 the municipal studies lose their force and that is the last day for filing WZ applications under the existing rules; from 1 September 2026 new WZ decisions will as a rule be issued only in the infill development areas designated in the municipal plan ogólny. WZ decisions that became final from 1 January 2026 are valid for 5 years, earlier ones remain valid indefinitely. How to check the MPZP and what you can read from it

The MPZP is an act of local law adopted by the municipal council under the act of 27 March 2003 on spatial planning and development. You read the designation of the plot straight from the resolution: MN is single-family housing, MW — multi-family, U — services, R — agricultural land, ZL — forests. The plan also sets the parameters that determine what you can actually build: building lines, maximum height, development intensity and the minimum share of biologically active surface.
You can check the plan preliminarily and free of charge in the municipal geoportal. For a transaction and for the bank, however, you need the official extract and map excerpt: the stamp duty — at the rates in force in August 2026 — is PLN 30 for an extract of up to 5 pages (PLN 50 above that) and PLN 20 for each page of the map excerpt, no more than PLN 250 in total. The office usually issues the document within 7 to 14 days.
Read the plan as a whole, not just the symbol on your own plot: just beyond the boundary of an MN area the plan may provide for a collector road, a production facility or a mast, and that has a direct effect on value and comfort.
How to obtain warunki zabudowy when there is no plan

Where there is no plan, the possibility of building is decided by the decision on warunki zabudowy. It is issued on application by the wójt, mayor or city president — and the applicant does not have to be the owner of the plot (as of August 2026), so you can apply for a WZ even before the purchase, or ask the seller to do so.
The key rule is the so-called good neighbourhood principle from art. 61 of the act: at least one neighbouring plot accessible from the same public road must be developed in a way that allows the parameters of the new development to be determined. Added to that are the conditions of access to a public road, sufficient utility infrastructure (existing or planned) and the absence of any need to obtain consent for a change of designation of agricultural or forest land.
Figures worth knowing (as of August 2026):
- stamp duty on the application: PLN 598; the owner or perpetual usufructuary of the plot is exempt from it (a power of attorney costs an additional PLN 17),
- statutory deadline for issuing a decision for a single-family house: 90 days (21 days for a house of up to 70 m²); in practice it tends to be longer, because periods of consultation and suspension are not counted towards the deadline,
- a WZ gives no title whatsoever to the land — several different people may obtain a decision for the same plot.

What the planning reform changes and why 31 August 2026 is the cut-off date

The amendment to the planning act of 7 July 2023 rebuilds the whole system: every municipality is to adopt a plan ogólny — an act of local law replacing the existing studium. The deadline has been postponed twice: from 31 December 2025 to 30 June 2026 (the act of 4 April 2025), and then to 31 August 2026 (the act of 30 April 2026, Journal of Laws 2026 item 781). On that day at the latest the municipal studies lose their force.
For buyers of plots this means three things:
- WZ applications filed no later than 31 August 2026 are considered under the existing rules — also after that date,
- from 1 September 2026 new WZ decisions will as a rule be issued only in the infill development areas (obszary uzupełnienia zabudowy, OUZ) designated in the plan ogólny, and a municipality that has not adopted a plan ogólny will not issue a new decision until it does,
- WZ decisions that became final from 1 January 2026 expire after 5 years (art. 64c of the act); those that became final earlier, and those issued in proceedings initiated before 16 October 2025, remain valid indefinitely.
The practical conclusion: if you are considering a plot without a local plan, a complete WZ application filed by the end of August 2026 secures the handling of the case under the old rules, before the plan ogólny narrows the development areas. Check with the municipality what stage the plan ogólny is at and whether the plot will fall within an OUZ — that is one of the factors that shape land prices in 2026.
Is „media w drodze” enough to build?
Listings are fond of the phrase „media w drodze” (utilities in the road). Before you believe it, apply for connection conditions. Under the regulations in force in 2026, the water and sewerage company has 21 days to issue them for single-family construction (45 days for other buildings); the document is free of charge and valid for 2 years. Similar conditions for electricity are issued by the distribution network operator — for a typical house within a period counted in weeks, not months.
If there is no network, count the cost of the alternatives: a deep well, a sealed septic tank or a domestic sewage treatment plant — each of these solutions has distance requirements from the plot boundaries and from water intakes, which on a small parcel can block the project altogether.
How to check whether access to the plot is legal
A condition for issuing a WZ and a building permit is access to a public road: direct, via an internal road or via a road easement disclosed in the księga wieczysta (land and mortgage register). „The neighbour always let us drive through” has no legal force whatsoever — after his plot is sold you may be left with land and no access.

Can agricultural land be converted into a building plot?
Agricultural land often means a lower price, but the procedure under the act of 3 February 1995 on the protection of agricultural and forest land consists of two stages. The first is the change of designation — as a rule possible only in the MPZP, and for land of classes I–III outside city boundaries it additionally requires the consent of the minister responsible for agriculture. The second is exclusion from agricultural production by a decision of the starosta, which comes with a charge and annual fees — although for residential construction an exemption of up to 0.05 ha applies to a single-family building.
Within city boundaries it is simpler, but do not skip the soil quality class of the land (you will find it in the extract from the land register) all the same. We describe the whole procedure, the costs and realistic timelines separately in our text on converting an agricultural plot.
Checklist before buying a plot
- Extract and map excerpt from the MPZP, or a certificate that there is no plan — plus information on whether the municipality has already adopted a plan ogólny and whether the plot lies within an infill development area.
- Księga wieczysta: owner, easements, mortgages, claims.
- Extract from the land register: land use type and soil quality class.
- Connection conditions for water, sewerage and electricity — in writing, not verbally.
- Legal access to a public road (or a share in an internal road).
- The surroundings: planned investments nearby, conservation protection zones, flood-prone areas.

Can a house be built on agricultural land?

For a single-family building an exemption from charges applies up to 0.05 ha. The procedure takes from months to years.
