Converting an agricultural plot into building land — the path and the reality

Converting an agricultural plot into building land always means two stages: first a change of the designation of the land (the MPZP or a decision on warunki zabudowy), then the exclusion from agricultural production by the starosta. The whole process takes from a few months — when the MPZP already allows development — to several years, when you have to wait for the plan to be amended. The cost depends on the soil class: for classes IV–VI on mineral soils the exclusion is free, and up to 500 m² for a single-family house you pay nothing regardless of class (as of 2026). Above that limit, for classes I–IIIb, the charge reaches from about PLN 262,000 to PLN 437,000 per hectare, reduced by the market value of the land. A WZ decision costs PLN 598 in stamp duty and must be issued within 90 days (21 days for a small single-family house). Watch the deadlines: from 1 January 2026 new WZ decisions are valid for only 5 years, and from 1 September 2026 — that is, in a matter of days — you will only be able to file a new WZ application in a municipality that has adopted a plan ogólny. What is the difference between changing the designation of land and excluding it from agricultural production?

In everyday language “odrolnienie” is one word; in the regulations it is two separate procedures. The first is a change of the designation of the land (the planning stage): the plot stops being agricultural “on paper” because the miejscowy plan zagospodarowania przestrzennego (MPZP, the local zoning plan) or a decision on warunki zabudowy (WZ, planning conditions) allows development on it. The second is the exclusion of the land from agricultural production (the factual stage): a decision of the starosta that lets you physically start building — strip the topsoil and put a spade in the ground. The order is fixed: without the first stage you will not get through the second, and without the second you will not obtain a building permit.
How to check whether a plot has a local plan or needs a WZ decision

Start by checking whether the plot is covered by an MPZP — you can do that at the municipal office or in the municipal geoportal, and formally you order an extract and a map excerpt from the plan. - The plan provides for development — the most convenient case: the planning stage is behind you and you move straight on to the exclusion from agricultural production.
- The plan marks the plot as agricultural (symbol R) — the only route is an application to the wójt or the mayor to amend the MPZP. The application is free, but the municipality has no statutory deadline for considering it; in practice amending a plan can take years or never happen at all.
- There is no plan — you apply for a WZ decision. The plot must meet the conditions of art. 61 of the act on spatial planning and development, above all the so-called good neighbourhood rule (at least one built-up plot accessible from the same public road) and access to a public road. The stamp duty is PLN 598 (as of 2026), whereby the owner and the perpetual usufructuary of the plot are exempt from it. The office has 90 days to issue the decision as a rule, and 21 days for a detached single-family house of up to 70 m².
An important caveat: soil classes I–III are protected by the act on the protection of agricultural and forest land. Designating them for non-agricultural purposes requires, as a rule, the consent of the minister responsible for agriculture and takes place within the procedure for adopting an MPZP — outside infill development areas the WZ route is in practice closed for them. When do you need a decision on the exclusion of land from agricultural production?

Once the MPZP or a final WZ allows development, you file an application with the starosta for the exclusion of the land from agricultural production. The decision is required for agricultural land of classes I–III (regardless of the origin of the soil) and for classes IV–VI formed from organic soils, for example peat. For mineral soils of classes IV–VI a decision is usually not needed — which significantly simplifies the investment (as of 2026). With the application you enclose, among other things, an extract from the land register, an extract from the MPZP or the WZ decision, a site development plan with a land balance, and a document confirming legal title.
Good news for people building a house: if the area excluded for a single-family building does not exceed 0.05 ha (500 m²), you pay neither the charge nor the annual fees. For a multi-family building the limit is 0.02 ha per residential unit.
How much does excluding land from agricultural production cost in 2026?
Above the 500 m² limit the rates from the act on the protection of agricultural and forest land come into play, unchanged for several years (as of August 2026) — a one-off charge calculated in proportion to the area being excluded:

The charge is reduced by the market value of the land being excluded, so the real cost is often noticeably lower than the rate in the table. On top of that come annual fees: 10% of the charge, payable for 10 years in the case of a permanent exclusion. A sample calculation: excluding 0.1 ha of class IIIb land means a base charge of about PLN 26,230, from which you subtract the market value of those 1,000 m² — only the difference is actually payable.
Who can buy an agricultural plot near Warszawa?
Before you count the cost of odrolnienie, check whether you can buy the plot at all. The act on shaping the agricultural system (UKUR) divides the market by three area thresholds:
- Below 0.3 ha of agricultural land — since 5 October 2023 the act does not apply at all: anyone can buy, with no consents and no pre-emption right.
- From 0.3 ha to 1 ha — a person who is not a farmer can also buy, but KOWR has a pre-emption right. The agreement is concluded before a notary as a conditional one, and KOWR has 30 days to decide whether it steps into the buyer’s place. - 1 ha and more — the buyer may as a rule only be an individual farmer; everyone else needs the consent of the Director General of KOWR, issued in the form of an administrative decision.
Remember the obligations after the purchase as well: the buyer of an agricultural property may as a rule not dispose of it for 5 years, and with larger areas an obligation to run a farm is added. The act provides for exceptions — among others for plots of up to 1 ha within the administrative boundaries of cities. What changes with the planning reform from 1 September 2026?
The 2023 spatial planning reform has entered its decisive phase. Since 1 January 2026 art. 64c of the planning act has been in force: new WZ decisions expire 5 years from the day they became final. This does not apply to decisions that became final before that date, nor to those issued in proceedings initiated before 16 October 2025 — those remain valid indefinitely.
The second and more urgent deadline is 31 August 2026 — the last day on which the existing municipal studies of conditions remain in force, replaced by municipal plany ogólne. From 1 September 2026 you will only be able to effectively file a new WZ application in a municipality that has managed to adopt a plan ogólny; where there is no plan yet, the issuing of new decisions is suspended until it enters into force. Once a plan ogólny has been adopted, WZ decisions will be issued exclusively in the infill development areas designated in it. If your plot meets the conditions for a “wuzetka” today and the municipality does not have a plan ogólny yet — this is no longer a question of “a year or two”: it is worth filing the application in the coming days, before 1 September 2026.
Checklist before buying an agricultural plot
- Order an extract from the land register and check the soil quality class — classes I–III in the countryside are better avoided.
- Verify the MPZP or how realistic it is to obtain a WZ (neighbouring development, road access).
- Calculate the cost of the exclusion from production and use the 500 m² limit for a single-family house.
- Check the area of agricultural land against the UKUR thresholds: 0.3 ha and 1 ha.
- Ask at the municipality whether a plan ogólny has already been adopted — from 1 September 2026 it determines whether you can file a new WZ application at all.
